The International Criminal Court (ICC) has declared that it will hear and confirm charges of war crimes and crimes against humanity against Joseph Kony, the notorious leader of the Lord's Resistance Army (LRA), in absentia.
This verdict is an important step forward in the long-running effort to bring justice to the victims of the LRA's cruel campaign in northern Uganda and surrounding countries.
Speaking to the press in Gulu on Monday November 18, 2024, Dahirou Sant Anna, the international cooperation advisor from the Office of the Prosecutor-ICC, revealed that the development is coming because Kony has yet to come and be prosecuted in person.
He added that under the Rome Statute, if a suspect has fled and all reasonable efforts to bring him before the court have failed, and all efforts to inform him that a hearing will take place have failed, the prosecutor of the court has the authority to request that type of hearing.
Leonie Van Braun, senior trial lawyer from the Office of the Prosecutor-ICC, stated that the International Criminal Court judges have agreed that a prudent move be made to begin the confirmation of the trial in his absence.
The International Criminal Court and its partners have taken all reasonable measures to try to get Kony arrested over the past few years, she disclosed, and the judges have agreed that charges against someone who cannot be located within the meaning of the statute should be heard in this manner.
She does, however, stress that the court's top objective is to get Joseph Kony arrested and that a full trial will not proceed without him present.
Since 2005, Joseph Kony has been charged by the ICC with war crimes and crimes against humanity, which include child soldier recruitment, enslavement, and murder.
Kony continues to be a symbol of impunity despite years of evasion, which has prompted calls for accountability from the international community and human rights organizations.
After a protracted search for and capture of Kony, who has eluded capture since the ICC issued its arrest warrant, the ICC has decided to confirm the accusations in absentia.
The court's ruling demonstrates the increasing necessity to provide justice for the thousands of people harmed by the violence committed by the LRA, which has killed and displaced countless people throughout northern Uganda.
The accusations against Mr. Kony, according to the International Criminal Court, include ordering and inciting LRA fighters to intentionally direct attacks against the civilian population, including killing civilians and attempting to kill them, torturing, severely abusing, mistreating, and treating them cruelly, enslaving abducted civilians, pillaging and destroying property, and persecuting civilians based on their age and gender in addition to having a common plan with other members of the Lord Resistance Army to carry out these acts jointly and through others.
The following attacks on internally displaced persons camps were committed in connection with the LRA attacks on the Lwala Girls School on or around June 24, 2003: Pajule IDP camp on or around October 10, 2003; Abia IDP camp on or about February 4, 2004; Barlonyo IDP camp on or about 21 February 2004; Odek IDP camp on or about 29 April 2004; Pagak IDP camp on or about 16 May 2004; Lukondi IDP camp on or about 19 May 2004; and Abok IDP camp on or about 8 June 2004.
Additionally, the prosecution accuses Mr. Kony of committing similar crimes against hundreds of women and hundreds of children who were reportedly incorporated into the LRA in northern Uganda between July 1, 2002, and December 31, 2005.
Early in 2025, the ICC will begin the charges confirmation hearing in absentia, highlighting its dedication to respecting international law and making sure that those who perpetrate horrible crimes are held accountable.
It is anticipated that this historic trial will get a great deal of public attention, highlighting the continued suffering of those impacted by the LRA and reaffirming the ICC's commitment to combating impunity worldwide.
