Petitioners over the current size and boundary of Arua city are yet to receive the ruling in which the constitutional court dismissed their petition challenging creation of Arua city and her boundaries.
In a case filed by Adroa Levi against the Attorney General, the petitioner argued that the inclusion of seven sub-counties into Arua City was unconstitutional, citing lack of consultation and violation of Articles 1, 176, and 179 of the Constitution, as well as Section 7 of the Local Governments Act, which he said deprived the Ayivu people of services.
However, the Attorney General defended the process, stating that Parliament acted within its legal mandate under Article 179 of the Constitution and Section 7 of the Local Governments Act. Government also presented evidence that the affected sub-counties consented through resolutions passed by their local councils and subsequent parliamentary approval.
In its ruling, the Constitutional Court Uganda sitting in Kampala on 1st April 2026, led by Justice Ketrah Kitariisibwa Katunguka with Justices Flavian Zeija, Fredrick Egonda-Ntende, Florence Nakachwa, and John Mike Musisi agreed with the Government, finding that consultation was adequately conducted through elected representatives and that due process was followed. The court further held that no constitutional violation had been proved.
The petition was therefore dismissed, with each party ordered to bear its own costs, citing the public interest nature of the case.
When contacted, petitioner Adroa Levi said he was yet to be served with the ruling and could not comment further.
“I have not yet received the official document so therefor I cannot make a comment on hearsay”. Adroa stated
Council Abibo, a lawyer and Managing Partner of Sinai Associates and Partners, says the judgment was fairly delivered, adding that the only option left for the petitioners is to lobby their political leaders to advocate for the creation of more administrative units.
“If they are left with any other choice, it is now political because when they are now going appeal given that judgment my own opinion is that appeal will be hard for them”. Abibo explained
Since the creation of Arua City in 2020 by an Act of Parliament, the then seven sub-counties in Ayivu County covering 382 square kilometers were amalgamated to form Ayivu Division, forcing residents to travel long distances to access services at the division headquarters in Onduparaka.
